These Mobile Text Terms of Use (“Mobile TOU”) govern your participation in the text messaging program (the “Program”) provided by Zupan’s Markets, Inc. (“Zupan’s Markets” or “Company”). Please read this Mobile TOU carefully. By consenting to participate in the Program, you agree to this Mobile TOU, the Zupan’s Loyalty Program Terms and Conditions, and Zupan’s Markets’ Terms of Use, and confirm that you’ve read and understand the Company’s Privacy Policy. Your access to, and use of, the Program represents your agreement to these Mobile TOU.
IF YOU DO NOT AGREE WITH THIS MOBILE TOU, INCLUDING CHANGES THERETO, DO NOT ACCESS, SUBSCRIBE, OR USE THE PROGRAM.
1. Program Description
The Zupan’s Markets text messaging program is an account information and marketing program that sends participants updates on account activity, great deals, special offers, and other brand-specific communications. This information is delivered directly to your mobile phone via SMS and/or MMS. As a Program participant, you may receive order updates, special deals, insider news, and access to in-store events, among other communications.
2. Mobile Messaging Terms
When you opt into our service with your mobile number, you are expressly agreeing that the Company may send text messages (including SMS and MMS) to that phone number. You also agree to pay the charges to your wireless bill or to have them deducted from your prepaid balance for this service. You acknowledge that you are at least 18 years of age and that you have the consent of the wireless account holder. Message frequency varies. The number of account updates and informational messages you receive will depend on your activity with us.If you signed up by texting a signup keyword, you will receive a confirmation text message and may need to reply as instructed to complete registration. Message and data rates apply. Reply STOP to cancel, HELP for help.
Texts may be sent through an automatic telephone dialing system. Consent is not required as a condition of purchasing any goods or services. You agree to notify the Company of any changes to your mobile number and update your subscription accordingly. Carriers are not liable for delayed or undelivered messages.
3. How to Sign Up
To sign up for the Program and receive texts with special offers, events, and insider information, you may:
- At a store location, type your mobile phone number into the pin pad at checkout and select “yes” when prompted
- Online, visit COMING SOON and enroll in the Zupan’s Loyalty Program
- Text JOIN to +1 (971) 397-9744 to opt in via SMS
You will receive a text from Zupan’s Markets prompting you to reply. Reply with the appropriate confirmation to specify the messages you wish to receive and confirm your agreement to these Mobile Terms of Use.
4. How to Stop Receiving Text Messages
To stop receiving promotional or account update text messages from Zupan’s Markets, text STOP to +1 (971) 397-9744 at any time. Upon opting out, you will receive a final text message confirming your opt-out. None of these opt-out trigger words are case sensitive.

5. Help Command
For help at any time, text HELP to +1 (971) 397-9744. This will provide you with our contact information and a description of the Program.
6. Requirements
To take advantage of the Company’s text messaging program, you must have a text messaging-enabled mobile device with an active text messaging plan.
7. Supported Carriers
The Company’s text messaging program works with all major U.S. carriers and a host of other smaller regional carriers. Your carrier may prohibit or restrict certain mobile features, and certain mobile features may be incompatible with your carrier or mobile device. Contact your carrier with questions regarding these issues.
8. Privacy
Please refer to the Zupan’s Markets Privacy Policy at www.zupans.com/privacy-policy for information about how we collect, use, and share your personal information in connection with the Program. Mobile opt-in data and consent to receive text messages will not be shared with or sold to third parties for their marketing purposes.
9. Changes to These Terms
The Company reserves the right to modify these Mobile TOU by posting new versions on the Website as well as the right to provide additional notices of significant changes. Your continued use of the Program following such changes constitutes your acceptance of those changes.
