Zupan’s Markets developed the Zupan’s Loyalty Program (the “Program”) to show appreciation for our customers who shop with us and support our shared values of quality food, community, and local sourcing. By registering to participate in the Program, you acknowledge that you have reviewed these Terms and Conditions and agree to the following rules governing the Program.
1. Program Overview
The Program is a loyalty program sponsored by Zupan’s Markets, Inc. (“Zupan’s Markets”, “we”, “our”, or “us”) through which customers can earn and receive Points through qualifying purchases at our locations. Program participants (“you” or “your”) may earn and receive Points with the choice to redeem for Rewards or store them for later use. You can redeem your accumulated Rewards at a Zupan’s Markets location. You can track Points and Rewards by signing into your account at COMING SOON.
2. Your Zupan’s Loyalty Membership
Upon initial enrollment in the Program, you will be issued a Zupan’s Loyalty account associated with a corresponding phone number of your choice. This membership is personal to you; however, immediate household family members may also use this account to receive points and discounts. Your Zupan’s Loyalty membership is good only at Zupan’s Markets store locations in Oregon.
By enrolling in the Program, each member fully understands and agrees to Zupan’s Markets’ use of the member’s name, email address, phone number, zip code, birthdate (MM/DD/YYYY), and purchasing information as stated in the Privacy Policy. Each individual is limited to a single Zupan’s Loyalty membership. Zupan’s Markets may cancel the membership of any individual who has enrolled more than once.
3. Participation Details
- Participation in the Program is subject to these Terms and Conditions and any supplemental rules or policies (“Program Rules”) that we may adopt from time to time. The interpretation and application of the Program Rules are at our sole discretion.
- We have the right to change, limit, modify, amend, or cancel the Program, Program Rules, Points, Rewards, and participation requirements at any time, with or without notice. Any such changes will be posted on our website.
- You are responsible for remaining knowledgeable as to any changes we may make to the Program and these Terms and Conditions.
4. Program Registration
- Only individuals 18 years of age or older are eligible to participate in the Program. Each individual may maintain only one account. Households may share an account.
- To enroll in the Program: (a) In-store, type your mobile phone number into the pin pad at checkout and select “yes” when prompted to enroll. (b) Online, visit COMING SOON and follow the on-screen instructions to complete your registration.
- There is no fee for enrolling or participating in the Program.
- We reserve the right to terminate your membership in the Program at any time based on violations of the Program Rules, fraud, or violations of any laws or regulations in connection with the Program’s privileges. If your membership is terminated, you will forfeit your Points and Rewards.
- You may terminate your participation in the Program at any time by notifying us by email at [email protected]. Your account will be terminated within 30 days of receipt of this notice.
5. How to Use Your Zupan’s Loyalty Membership
Look for specially marked Zupan’s Loyalty items throughout the store. When purchasing any such items, provide your cashier with the phone number registered with your Zupan’s Loyalty account prior to having your items scanned at checkout. Your savings will be automatically calculated and printed on your receipt. Only the member named on the Zupan’s Loyalty account may redeem points for rewards. Zupan’s Markets reserves the right to verify identification when redeeming points for rewards.
6. Earning Points
- Points can be earned by purchasing products at Zupan’s Markets store locations.
- You will earn one (1) Point for every $1.00 in net purchase amount. Points cannot be earned on purchases of postage stamps, gift cards, bottle deposits, or where otherwise stated.
- Periodically, we may provide the opportunity to earn additional Points through certain promotional offers as defined by the terms of the specific promotion.
- Points will begin accruing upon your enrollment date. Retroactive Points will not be awarded for purchases prior to enrollment.
- Points are void if not obtained in accordance with these Terms and Conditions.
- Your activity and Points will be recorded and tracked at the “Account” section of COMING SOON. You are responsible for ensuring the accuracy of your account.
- You are responsible for paying all federal, state, and local taxes related to Program Point redemption.
7. Zupan’s Loyalty Redemption
- Enrolled members may redeem earned Points in-store for Rewards. Points may be redeemed for your choice of savings off a grocery purchase, free or specially priced products, instant savings, or other promotional offers as determined by Zupan’s Markets.
- Rewards are not available for redemption until the next purchase made by an Enrolled Customer following the date the Points were earned.
- Rewards may not be redeemed for purchases of postage stamps, gift cards, bottle deposits, or for purchases made through third-party delivery platforms.
- Rewards earned on your account may only be redeemed through purchases of products made at Zupan’s Markets locations.
- Unused Rewards will expire and be forfeited forty-five (45) days after the date of award.
- If your account has been inactive for 180 days or more, any Points that remain in your account will be forfeited without compensation.
- Rewards and Points have no cash value and are only redeemable for purchases at Zupan’s Markets locations at the value rate determined by us.
8. Member Communication
Zupan’s Loyalty members agree to receive special offers and other information by text message, email, and electronic means on a periodic basis. This is not a condition of purchasing any goods or services. Members may opt out of receiving electronic communications at any time through the platform from which they received such communication. For text messages, text STOP to opt-out or HELP for help. Message and data rates may apply. For email, click the “unsubscribe” link in the email you received, or contact the Zupan’s Loyalty Department at [email protected].
9. Restrictions
- Points and Rewards may not be transferred to another person.
- Points and Rewards are not refundable, replaceable, or transferable for cash, credit, or other Points or Rewards under any circumstances unless otherwise stated by us in writing.
- There is no maximum number of Points that you can accumulate in the Program.
- You may not combine Points with other members’ accounts.
- If there is any abuse of the Program, failure to follow Program Rules, or any misrepresentation by you, all unredeemed Points shall be forfeited and you will be removed from the Program.
- Points and Rewards do not constitute property of an enrolled member and may be revoked at any time by us.
10. Program Limitations and Disclaimer
This Program is void where prohibited by law. ZUPAN’S MARKETS, ITS PARENT, AFFILIATES, VENDORS, AND SERVICE PROVIDERS MAKE NO CLAIMS, WARRANTIES, GUARANTEES, OR REPRESENTATIONS OF ANY KIND, EXPRESS OR IMPLIED, WITH RESPECT TO POINTS AND REWARDS AND SHALL NOT BE LIABLE FOR ANY LOSS, EXPENSE (INCLUDING, WITHOUT LIMITATION, ATTORNEYS’ FEES), OR INCONVENIENCE THAT MAY OCCUR IN THE USE OF THE PROGRAM. THE TOTAL LIABILITY OF ZUPAN’S MARKETS FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE PROGRAM, REGARDLESS OF THE FORM OF ACTION, IS LIMITED TO THE GREATER OF $100 OR THE EQUIVALENT AMOUNT OF POINTS OR REWARDS AT ISSUE.
11. Privacy Policy
Zupan’s Markets collects information on member transactions that are stored electronically. The type of information collected includes a member’s name, email address, phone number, zip code, birthdate (MM/DD/YYYY), and purchasing information. This information may be used internally as part of special merchandising and promotion programs. It is the policy of Zupan’s Markets that we do not sell, rent, or relinquish personally identifiable information to third-party vendors, suppliers, or marketers.

12. Dispute Resolution and Governing Law
These Terms and Conditions and your use of the Program will be governed by and construed in accordance with the laws of Oregon, without regard to conflict of law rules or principles that would cause the application of the laws of any other jurisdiction.
Except for small claims disputes or disputes seeking injunctive or equitable relief, all disputes arising out of or relating to the Program will be resolved through confidential binding arbitration held in Multnomah County, Oregon, in accordance with the Streamlined Arbitration Rules and Procedures of the Judicial Arbitration and Mediation Services (“JAMS”). You and Zupan’s Markets each waive the right to a jury trial and to participate in a class arbitration or representative action.
Any claim arising out of or related to these Terms and Conditions or the Program must be filed within one year after such claim arose; otherwise, the claim is permanently barred.
